If this farmer used the parental line under the IP coverage without permision, yes he will be sued.
This is about Interlectual property right, it has nothing to do with GMO.
We should not mix Chinese farmer with US farmer. They are apples and oranges.
In the case of China, what decide the cost of seeds production is not just time and laber, technology counts much more.
